Bill of Rights.

I’m fidgety and randomly had to quote the first amendment again. So, for fun, let’s review our rights.

Amendment I:

    Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the government for a redress of grievances.

Separation of church and state, freedom of thought, assembly, press, etc. Standard stuff everybody should know.

Amendment II:

    A well regulated militia, being necessary to the security of a free state, the right of the people to keep and bear arms, shall not be infringed.

You can have a gun in case Bush decides you’re a terrorist.

Amendment III:

    No soldier shall, in time of peace be quartered in any house, without the consent of the owner, nor in time of war, but in a manner to be prescribed by law.

You can’t be kicked out of your house just because some uniform says so.

Amendment IV:

    The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no warrants shall issue, but upon probable cause, supported by oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.

Government can’t go looking into your house looking for weed unless they have a warrent.

Amendment V:

    No person shall be held to answer for a capital, or otherwise infamous crime, unless on a presentment or indictment of a grand jury, except in cases arising in the land or naval forces, or in the militia, when in actual service in time of war or public danger; nor shall any person be subject for the same offense to be twice put in jeopardy of life or limb; nor shall be compelled in any criminal case to be a witness against himself, nor be deprived of life, liberty, or property, without due process of law; nor shall private property be taken for public use, without just compensation.

Makes double jeopardy illegal (being tried twice for the same crime).

Amendment VI:

    In all criminal prosecutions, the accused shall enjoy the right to a speedy and public trial, by an impartial jury of the state and district wherein the crime shall have been committed, which district shall have been previously ascertained by law, and to be informed of the nature and cause of the accusation; to be confronted with the witnesses against him; to have compulsory process for obtaining witnesses in his favor, and to have the assistance of counsel for his defense.

Right to impartial jury. (No mock trials.)

Amendment VII:

    In suits at common law, where the value in controversy shall exceed twenty dollars, the right of trial by jury shall be preserved, and no fact tried by a jury, shall be otherwise reexamined in any court of the United States, than according to the rules of the common law.

Right to a trial, period.

Amendment VIII:

    Excessive bail shall not be required, nor excessive fines imposed, nor cruel and unusual punishments inflicted.

I can not condense that further.

Amendment IX:

    The enumeration in the Constitution, of certain rights, shall not be construed to deny or disparage others retained by the people.

The rights of some can not deny the rights of others.

Amendment X:

    The powers not delegated to the United States by the Constitution, nor prohibited by it to the states, are reserved to the states respectively, or to the people.

Any right not specifically stated is assumed to be a right we have, or a rate the states can claim.

Oh sure, there’s a dozen more or so. But they’re so boring. Though, I’ll point out something I noticed a while ago.

Amendment XIV

    Section 1. All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the state wherein they reside. No state shall make or enforce any law which shall abridge the privileges or immunities of citizens of the United States; nor shall any state deprive any person of life, liberty, or property, without due process of law; nor deny to any person within its jurisdiction the equal protection of the laws.

You can’t selectively give people rights, or prohibit activity. Thus, if circumcision is illegal for females, it should be illegal for males.

Oh wait, that isn’t the case.

This was fun to read. I have to admit, I didn’t know half of the stuff listed here and I’m gonna come back and read this off and on for the next few weeks. It’s really interesting, and waaaay less boring than those other sites about the government, you know those cheesy ones with white backgrounds, black text and cheap-ass graphics – ugh. It’s much more interesting to hear your breakdown.

But V also protects you from testifying against yourself (as in, I plead the 5th…) And VI includes a speedy trial and also the right to confront witnesses. And XIV also protects our due process laws in criminal trials. The Constitution is a very, very cool document. It’s sad that more people don’t pay attention to these things. 🙂

Amendment IV: *coughpatriotactcough* Hmmm. I’m glad you posted this. I think people need to realize that “I don’t care” equates to “I agree” in the gub’mint’s eyes.

And rightly so. I’m not for circumcision…just so you know.

Well, considering a woman was ARRESTED at Dubya’s little speechie-weechie last night for wearing a T-shirt he didn’t like, I think Amendment I is on its way to being toast.

And after the Branch Davidians were attacked and brutally murdered for suspicion of stock piling weapons, Ammendment II is getting a little shaky. (I just watched that documentary about it on the documentary channel–depressing and the images of the dead children, CHILDREN, was uber-disturbing but I recommend it.)

So, if the government uses imminent domain to seize your house and make it a bunker to house soldiers are they violating Ammendment III, I wonder? ‘Cause a uniform sure as hell can come to your house and take it. Happens all the time for strip malls and other “worthy” institutions.

As for Ammendment IV, cops have gone into a persons house with “probable cause” without a warrant before, yesiree. In fact, just last year there was some big hoopty do over the fact that a cop saw an illegal substance through a basement window and so broke into the house. If I’m not mistaken, I believe that was upheld because he saw a crime “taking place” (what? weed growing? Veeeeery slowly…)
