Court and the IME doctor visit…
Evening OD family. How is everyone doing? Well it’s been crazy busy on this neck of the woods. I finally went to court for my hand/wrist on Monday. I also had to see the Independent Medical Examiner on Tuesday.
Monday – Court was at 11:10am up in the heart of Rochester. I was shitting my pants. I hate city driving. I live in a “city”, but my “city” is more of a city-let compared to Rochester. Anyways, Pat went with me [and drove seeing I would’ve had a huge anxiety attack], and we made it there in great time. My lawyer wasn’t even there yet. Anyways, my lawyer arrived 2 minutes before they called us into the room. The judge yelled at me for interrupting. I wasn’t doing it on purpose. Pat came in with us and the judge asked who he was. I told him that he was my significant other. He looked at me and asked for his name and I interrupted, on accident. So after he finished his question I told the judge his name. The lawyer for TOPS looked quite confident that he had an open/shut case. Not realizing I had a TON of medical documentation going against them. The judge is taking my case to trial. My trail date is August 11 at 2:30 in the afternoon. I was paying attention but not looking at anyone, but Pat said when all was said and done, TOPS’ lawyer looked pissed and he ran out of the room. My lawyer also asked about disability seeing I’m not getting paid. The judge ruled that payment should be made seeing the ONLY reason I’m not being paid is due to the C-7 form that TOPS filed saying it may or may not have happened at work, and apparently that’s not good enough. I asked my lawyer how far back they are going to go and he said when I first filed and that was MARCH 13!!! So I have to wait until next week to get the judges ruling in the mail and then call about getting some money!! Woo!!
Tuesday – Went to the IME doctor. That appointment was at 10am. I was dragging ass so bad that morning. I fell asleep in the truck on the way there, in the waiting room, and on the way home. The doctor was not from this country and had a thick Indian [as in from India] accent. Quite hard to understand. Anyways, he asked question about if I had injured myself prior to this blah, blah, blah…then he examined my had hand/wrist. He hit my wrist with that hammer thingy and instantly my fingers fell asleep. He squeezed the lump on my wrist and I wanted to punch him. It hurt like crazy. He went up to my elbow and was pressing around and my fingers went to sleep. After all that he said that he believed me, so I figure that’s a good thing. However, when I left my hand/wrist was throbbing so bad. When we got home, I curled up on the couch and passed out for 2.5 hours until Pat had to go to work.
I’m done with doctors this week. Next week I go to the Ortho. on Thursday and Dr. Manfred [a workers comp doctor seeing my family doctor doesn’t deal with workers comp] on Friday. I will be so happy when everything is all over. But I don’t see that anytime soon.
Today was a nice day. I went to my moms with the twins and baby Em. I had to get my head light bulb replaced. Kids had fun. Mom and I laughed and Em was great. We got home around 9:15 and all three kids were ready for bed and the moment each one hit the pillows they were out. 🙂
Well that’s about it. Just wanted to let you guys know all the good news and that things are slowly progressing.
