An Anonymous note…

Apparently there is “someone taking my poetry and using it as her own…” out there as the anonymous noter put it. Why would someone leave an anonymous note like that? At least give me a link to them or something in a private note.

Until someone shows me something, all I can do it keep writing. More poems coming soon, gang!

I have a friend here at the site who put all of his work on private because someone told him that people were stealing his poetry. I wouldn’t say it hasn’t happened or isn’t. Just be careful, whoever left the note might deliver proof. Just saw this on the front page, I’m not signed in, but it wasn’t me who left the note you refer to. – Tempest(nsi)

Her name is restrained_soul. she showed me this poem that she said she wrote called “January Rains” and I found your diary on random and saw that you had the same poem. And I know that this poem isn’t her style. And I can recall her copying and pasting something off of a blue diary such as yours. I am dissapointed in her. I’m sorry this happened to you, I should have said something sooner.

Look, I know who did it. Her name is restrained_soul. She puts poems in her regular journal. She gives credit believe me because I have seen them. I have seen many with the name Joe Jenkins next to them. Maybe the person who told you that was mistaken. But I do know that she keeps them in her journal, but you have credit and so do many others who have poems in there too. I have a few in there…

and I have credit. I know she would let you see her journal. I can’t believe someone would think that she would do that to anyone. However, if someone says that they seen one without your name by it, I think it would be there by now. I will tell restrained_soul what someone thinks because I know that she writes down your poems. Maybe she isn’t the one, but I do know that you do get credit for…

If your work is getting stolen I think you should sit on them:-p…..Thought I would lighten it up, be flatterd that someone loves your poetey so much that take it as their own……but still don’t let them get a ways with it. SIT ON THEM!!! Go OP!

Actually, putting a little (c) logo amounts to very little. To actually copyright something you must send it in to your local government (in Joe’s case, the U.S. copyright office), and this is usually accompanied by a fee and terms for how long the copyright will last, etc. FOD has a cursory copyright clause in that since entries are considered “published”, you could say that since…

you published it here, it was copyright. Most courts will uphold that (publication amounts to copyright); however, the FOD enviornment is one of free speech and people are free to say what they will, even if that means saying the same thing as others (e.g. poetry or entries in general). People from outside the U.S. (Joe probably doesn’t have any real copyright, but if he did it would probably…

within the bounds of the U.S. gov’t, meaning he’d have to apply to other gov’ts to copyright his work abroad) could also freely steal his work and get off the hook. You could take legal action, but that’s costly and pretty pointless. The poems aren’t making money, nor is the “thief”, so since there’s no damages there’s no real case other than simple “infringement”…

And, frankly, though a million people will flame me, who cares if people rip off FOD poems? I could care less if someone rips mine because it’s really not that good and I post for fun. Things I do try and get published I may post for audience ratings, but that’s about it and I have deleted many entries afterwards. Most FOD “poets” suck, or are just average, but enjoy patting themselves on…

the back to make themselves feel better, when what might really be helpful is some real critiquing of their work and analysis of other “great” poets (Browning, Tennyson, Eliot, Shakespeare) to hone their craft. Joe is a poet. I am currently reading through all his diary and I don’t see any constructive criticism. It’s all praise with a rare attack with no real basis in literature…

Anything you put on here is officially copyrighted. If you write a poem on a napkin, it is copyrighted. You do not have to write to the government or anything like that. Keep writing. The only problem is catching people stealing things. You are very talented. Feel free to visit my diary. šŸ™‚
