The Legality of a Surrogate Who Wants to Keep a Baby in Nevada

In Nevada, surrogate agreements are legally binding and enforceable. Generally, the carrier will not be allowed to keep the child.

However, there are exceptions to this rule. If a surrogate changes her mind and decides to keep the baby she carried, a legal battle may ensue.

The courts will consider factors such as:

  • The best interests of the child
  • Any evidence of fraud or coercion
  • The intentions of both parties at the time of the agreement

Can a surrogate decide to terminate the pregnancy?

Yes, the law makes provision for the right to termination for medical reasons. The surrogate must inform the commissioning parents about the need and decision to do so. In this instance, the commissioning parents will still have to pay for the expenses. If, however, the surrogate decides to terminate the pregnancy for reasons other than medical, she must discuss the issue with the commissioning parents and will then be liable for the expenses associated with the surrogacy.

Commissioning Parents Have Legal Rights

The myth that the surrogate may decide to keep the baby is also dispelled. In South Africa, the commissioning parents become the rightful parents upon birth of the child and the surrogate mother cannot legally terminate the pregnancy for reasons other than medical. If there is a valid reason, the court will decide and it can only be done after discussion with the parents.

A surrogate to a partial surrogacy agreement has 60 days during which she can terminate the agreement after the birth of the child. However, in terms of gestational surrogacy agreement, the parties to the agreement are not given the option to terminate the agreement. Additionally, in this case, the surrogate mother cannot refuse to relinquish the child to the commissioning parents.
