there is no moral equivalency between a horror writer and this school classroom asignment, CNN article quote: “Another passage in the essay advised his teacher at Cary-Grove High School: “don’t be surprised on inspiring the first CG shooting,” according to a criminal complaint filed this week.” He threatened to commit a crime, he threatened to kill his classmates, he threatened the teacher. Generalizing the issue to the point of abstraction might make this seem trivial but he made his teacher afraid of him (and probably a few of his classmates after they found out). That’s not reasonable or acceptable anywhere. Just because something is a freedom doesn’t mean it should be abused. The teacher could not have foreseen the student taking the “write whatever comes to your mind. Do not judge or censor what you are writing,” part of the assignment as a justification to threaten violence. IF the teacher hadn’t made an issue out of it and he had gone through with it, no one would be saying, “Well, it was a creative writing assignment, why should anyone have thought anything of it?” They would have been screaming about how this was a warning sign.

Being creative doesn’t mean lack of common sense. Having freedom of speech doesn’t mean the ability to shout, “Fire!” in a crowded theater. He wrote, “Blood, sex and booze. Drugs, drugs, drugs are fun. Stab, stab, stab, stab, stab, s…t…a…b…puke. So I had this dream last night where I went into a building, pulled out two P90s and started shooting everyone, then had sex with the dead bodies. Well, not really, but it would be funny if I did.” A responsible teacher takes one look at that and errs on the side of caution, regardless of circumstance. The parents of his classmates are not having a philosophical debate over whether or not his First Ammendment rights were violated, they are happy they don’t have worry about their child not coming home because some idiot kid with a gun thinks it’s cool to play first person shooter in real life or has to teach the world a lesson for all it’s unfairness. As I said, even if none of that were true, he’s still an idiot for saying things in an emotionally charged time where of course there was going to be an overreaction even without the multiple death threats.

He told the teacher point blank, “don’t be surprised on inspiring the first CG (Cary-Grove High School) shooting”. That’s not a random sampling, that’s the whole basis for the criminal complaint against him. It stopped being just an assignment the moment he made an overt threat. Threatening to commit a violent act (premeditated mass murder in this case) is a crime. Period. That is the law. Abetter analogy would be that a person (here anyway) has the right to own and carry a weapon IF they have a permit. Does that mean they can carry it anywhere they want? No. Churches, certain businesses, airports, and so on will post signs informing a person that it is not permissable to carry a weapon into their building. It’s called having limits and most people get that. For the same reason, the same gun carrying person couldn’t just randomly point it at people because he has a permit to have/carry said weapon. People have a right not to be threatened with violence simply because they live in a free society. Had he not suggested it was about to become reality, he would have been fine but that was the line he chose to cross and now he is paying for it.

the larger issue, which I forgot to address, is WHERE the free speech is occuring, while one has the right to express what they want, they don’t have the right to express it ANYWHERE they want, if a person yells “Fire!” in a theater, it’s not only a crime (public endangerment, disturbing the peace), if anyone is killed as a result of a stampede to the exits, that person can and will be charged with manslaughter, a novelist is free to write anything he wants and sell it, a public school student does not have the right to threaten faculty or fellow students, I went to a school where having aspirin in your locker could get you suspended, other schools have expelled little children for bringing a butter knife to school to make their sandwich for lunch, schools can search lockers and bookbags if they suspect contraband, iPods are banned, and so on, it’s ridiculous to be sure, but that is the flip side to living in a free society, laws and rules still have to be followed regardless of whether or not they are agreed with, in this case, he broke the law and spin it any way you like, part of being educated in a public school is giving up a certain amount of freedom
